Together with our Real Estate team, our Litigation department successfully gave rise to one of the most significant rulings seen in Israel lately in the field of urban renewal, as part of an appeal that raised questions of principle and especially the priority of evacuation-construction plans over TAMA 38 (renovation-stablization plan).
In a decision by the Appeals subcommittee of the National Council for Planning and Construction, an appeal for the "Beit HaGefen in Jerusalem" project was rejected.
This is an evacuation-construction project in the Gilo neighborhood of Jerusalem, in which our Real Estate team secured a decision that impedes a "competing" permit under TAMA 38. The "competing" developers have appealed to the National Council.
Representation was provided by Head of Litigation and Dispute Resolution, Yechiel Kasher, Assaf Priel, Head of Real Estate, Sigal Shapira, Head of Zoning, Shoam Keren, Gabriel Sagi and Noa Anya Schneiderman.
