Our firm represents a multi-national manufacturing company and its subsidiaries before the governmental committee known as the Second Sheshinski Committee (the “Committee”). The Committee was given the mandate to examine whether the State of Israel currently receives a fair share of profits from the extraction of natural resourses in Israel by private entities. During the work of the Committee, we submitted several opinions dealing with the legality of amending the current legal regime and the proposed fiscal arrangement. As part of this process we collaborated with internationally renowned experts, submitting to the Committee economic and financial opinions that examine the common worldwide fiscal regimes regarding extraction of natural resources, and the expected ramifications of applying the proposed arrangement to our client. We also presented our client’s position in oral hearings of the Committee and submitted comments to the Committee’s interim recommendations. In October 2014, the Committee published its final recommendations, which included significant amendments to its interim recommendations. The Israeli Government approved the recommendations, which have yet to be legislated.
