Our firm represents the concessionaire in an arbitration with respect to the legality of the termination of a BOT concession by the State of Israel, which is the largest formal light rail related infrastructure dispute to arise in Israel. At the center of the arbitration is the largest, most complex and expensive infrastructure project ever undertaken in Israel. The dispute resolution process was initiated by the concessionaire in October 2010, following the State of Israel’s notice of termination of the BOT concession and the forfeiture of the ILS 138 million guarantee provided by the concessionaire. In its claim, the concessionaire seeks enforcement of the BOT concession and should enforcement be found to be unfeasible, an additional sum of approximately ILS 1.8 billion. In response to the concessionaire’s claim, an ILS 720 million counter-claim was submitted by the State of Israel to the Dispute Resolution Panel.
