Our firm represented a major global pharmaceutical company, as co-defendant along with other pharma co-defendants, in a Tort claim brought by two plaintiffs, who alleged that their HIV and/or HCV, was caused by tainted blood factors received in the 1980’s. The District Court dismissed the claims on grounds of limitation. Plaintiffs filed an appeal before the Supreme Court of Israel alleging, inter-alia, that some of the facts pertaining to the claim were not known to them and therefore the claim was not time-barred. The Supreme Court recently rejected the appeal.
